What are the latest requirements for SDVOSB certification through the SBA in late 2026?

My veteran-owned business is looking to get certified as an SDVOSB for federal contracts. We do court reporting and legal support services. I know the NDAA for Fiscal Year 2021 transferred VOSB and SDVOSB certification from the VA to the SBA, and that happened in 2023. I'm trying to figure out if there have been other changes since then. We are working on a sources sought notice for the VA, and they mentioned SBA certification is now required for an SDVOSB set-aside.

What are the current ownership and control rules for SBA SDVOSB certification? Are there any specific requirements for service-disabled veterans themselves that I need to know about?

The latest requirements for SDVOSB certification through the SBA in late 2026 are that the concern must apply to SBA for certification and must be at least 51 percent owned and controlled by one or more veterans. The NDAA for Fiscal Year 2021 transferred VOSB and SDVOSB certification from the Department of Veterans Affairs to the SBA as of January 1, 2023. Since January 1, 2024, only an SBA-certified SDVOSB designated in SAM.gov may receive an SDVOSB sole source award. This applies when the anticipated price, including options, will not exceed $8.5 million for manufacturing NAICS codes or $5 million for any other NAICS code, as stated in FAR 19.1406(a)(2) and (b). The SBA veteran contracting assistance programs page on sba.gov provides additional details on these requirements.
