My firm is an SBA-certified SDVOSB providing legal support services, and we are looking at federal sole-source opportunities. I recently heard about some changes to the SDVOSB sole-source rules that took effect on January 1, 2024. We bid on a lot of VA and DoJ work, often through BPAs, and I want to make sure we are targeting the right opportunities. I am trying to understand the specific requirements and thresholds for these awards now. What are the current requirements for an SDVOSB sole-source award, and what are the maximum dollar thresholds for these awards as of January 1, 2024?

As of January 1, 2024, to receive an SDVOSB sole-source award, your firm must be an SBA-certified SDVOSB designated in SAM.gov. The NDAA for Fiscal Year 2021 transferred VOSB and SDVOSB certification from the Department of Veterans Affairs to SBA as of January 1, 2023. Your firm must apply to SBA for this certification and be at least 51 percent owned and controlled by one or more veterans. These requirements are outlined on the sba.gov veteran contracting assistance programs page and in 13 CFR 128.300.

The maximum dollar thresholds for an SDVOSB sole-source award are $8.5 million for manufacturing NAICS codes or $5 million for any other NAICS code, including options. This is stated in FAR 19.1406(a)(2) and (b). These awards are for federal buys following the FAR. State and local government procurements will follow their own state procurement codes and portal vendor guides, which can differ from federal rules regarding thresholds and certification.
